  FEEDBACK ON POLICIES

 POLICIES AND GUIDELINES ON GATED COMMUNITIES 

MIP Comments/ Suggestions/ Observations:

  1. MIP has made a stand that GACOS should not be encouraged but should there be a demand for it, the developments must adhere to set of strict guidelines which must be properly enforced.
  2. In terms of the provision of services and the recommendation that large GACOS development must be parceled up to no more than 10 hectares each with shared services, MIP stated that the guideline that the developer need not provide schools would be unfari on other developers and the surrounding community. This is because the with a development of 10 hectares and if there were 4 such parcels, there would generate a large school going population that would be 'loaded' on to schools in surrounding areas, which would be unfair. Thus this examtion should be thoroughly looked into.
  3. On the guideline that gated developments shall not be allowed where there are streams, tributaries or a  river running through the property, MIP suggested  that this may not hold up in the court of law; there can be othe rmeans of having the waterways as public entity by requiring the land owner/ developer to surrender that part of the land to the government as river reserve, and thus enable the developer to develop other parts of the land as a GACOS.
  4. On the guideline that GACOS can only be built in city areas with high crime rates, MIP questioned on the availability of the data. Often, such information is considered "Official Secret". Thus who would be able to access this data before submission (in order to justify in the LCP) or during the processing of application? Another factor for consideration is the un-availability of the data to the developer when and if the applicant is refused planning permission and he takes it up to the Appeal Board.
  5. On the guideline that GACOS will not be permitted in rural areas, MIP questioned the relevancy and the ability to implement this rule effectively, as there will be, and already, are developments of homestead (eg. Planters Haven) or even a seaside areas, and hills and mountain resorts.
  6. On the minimum size of 1 hectares size of plot for a GACOS, MIP also questioned this requirement and to have it crossed checked with JPBD's Guidelines on the minimum size of land for apartment development ( 1 acre only).
